2.- Contents offered on the Web and its use.

2.1. Sections of the ATYCO Website: ATYCO makes available to the user, through its website, different content through the different sections that comprise it.

The user will be able to find information about ATYCO and its activity (architecture and design projects, as well as graphic examples of work already carried out)

The user will find information and photographs of the studio in which ATYCO carries out its work, as well as the human team that makes up ATYCO.

The user will find forms through which he/she can contact ATYCO, providing his/her personal data (name, email, telephone number) and information about how he/she found out about ATYCO and any other information or query he/she wishes to make in a free text field provided for this purpose. To this end, the user must read, and if he/she agrees, accept the terms of use and the privacy policy by checking the corresponding box.

The website has a blog: users can access information and articles related to design, architecture and interior decoration that ATYCO publishes.

The Website also has a shop: In this section, ATYCO offers the user different interior decoration products such as: furniture, lighting, rugs, outdoor furniture, children's furniture, accessories, etc. that can be purchased by the user in accordance with the contracting conditions published on the Website.

2.2. Use of the Web: Access to and use of the Web is free and open to the public, but the user who accesses or uses the Web is subject to these terms of use, which he or she accepts by the mere fact of accessing it.

The user declares to be over 18 years of age and to have sufficient legal capacity to be bound by these terms, expressly accepting without exception that access to and use of the Website, its services and content is carried out under his or her sole and exclusive responsibility.

If the user does not agree with the content of these terms of use, he/she must leave the Website and will not be able to enjoy the services and/or content it offers.

ATYCO wants all users who browse the Web to have an optimal experience and to be able to find and, where appropriate, acquire what they are looking for. Therefore, at all times, the user is obliged to make appropriate use of the resources of the Web, in accordance with the provisions of these terms, morality, public order, good customs and current legislation, without harming or damaging the owners of the Web or any third party, and therefore undertakes not to use the content and/or services offered by the Web to engage in illicit, illegal activities or activities contrary to good faith and public order; disseminate content or propaganda of a racist, xenophobic, pornographic nature, in support of terrorism or in violation of human rights; cause damage to the physical and logical systems of ATYCO, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that may cause the aforementioned damage; attempt to access and, where appropriate, use the email accounts of other users and modify or manipulate their messages.

2.3. User registration: Users wishing to place an order for any of the products offered in the STORE section will be required to register, obtaining a customer account called “MY ACCOUNT”, in order to be able to process the user's request, with their data always being treated in accordance with the provisions of the privacy policy. The registration procedure is very simple:

If you click on “My Account” in the footer menu of the “SHOP” section, you will access a page where the user can identify themselves if they already have a customer account by entering their email address and password.

If you do not yet have a customer account, you must enter your email address and click on the “CREATE ACCOUNT” button (at this time, ATYCO does not yet have access to the user's email address) to access a form in which the user can select the title they wish to receive (Mr./Mrs.) and provide the following information: name, surname, email address and a password of their choice.

Once registered, the user will have access to his/her customer account, called “MY ACCOUNT”, by providing the system with his/her username (which will be the email address) and password (which will be the one entered at the time of registration). If he/she has forgotten his/her password, he/she must click on the link “Have you forgotten your password?” and ATYCO will provide the user with the way to obtain a new one.

In “MY ACCOUNT”, the user can complete his/her details so that, in the event that he/she purchases any of ATYCO's products, they can be sent to the postal address provided by the user. Specifically, he/she can complete his/her profile by providing or correcting the following details:

Name; Surname; Company; Address, Postal Code, City, Country; Telephone; State, NIF/CIF, NIE, as well as a free field to provide additional information relevant to a possible shipment.

In addition, the system provides the option of entering another delivery address, if desired.

When the user completes this information, he or she will not be asked to accept the terms of use and privacy policy, as they have already been accepted upon registration.

The user is the sole and exclusive party responsible for ensuring that the data provided to ATYCO is up-to-date, complete and, of course, accurate and truthful. ATYCO will in no case be liable for failure to comply with such requirements in the data you provide us.

The user must take due care to prevent third parties from accessing and/or using the Website with their own access keys, and in this case, they shall also be solely responsible for the choice, loss, theft or unauthorized use of their username and/or password and for any consequences that may arise from this. Please note that the username and password are personal and non-transferable.

Consequently, the user is obliged to immediately inform ATYCO of any loss of his/her username and/or password, regardless of the cause thereof, or of any danger or loss of confidentiality, and shall otherwise be liable for any damage or harm caused by access verified using these access codes.

2.4. Contracting of the services and/or products of the Web.

The user may contact ATYCO to arrange an appointment and/or request a quote and information on how to contract the services of drafting construction projects (basic or execution), as well as the preparation of designs or interior decoration projects. However, these services cannot be contracted through the Web.

However, if the user wishes to purchase the products offered in the “STORE” section of the Website, such contracting can be done online in accordance with the Purchase conditions published on the web.

3.- Exclusion of guarantees and responsibility for the operation of the Web:

ATYCO will not be, under any circumstances, responsible:

From the lack of operability or punctual and/or temporary availability of the Web for reasons not attributable to it

Any damages and losses that may arise from such lack of operation and/or availability, without prejudice to the fact that ATYCO will do everything possible to guarantee the availability and operation of the service.

Any errors or security deficiencies that may occur due to the user using an outdated or insecure version of a browser, as well as any other cause solely attributable to the user.

4.- Intellectual and Industrial Property:

ATYCO holds all rights over the content, design and source code of the Website, in particular, but not limited to, images, photographs, texts, logos, designs, brands, trade names, data included on the Website, menu layout, graphics, colours, tools, etc. All programs used to develop the Website are the property of ATYCO or its suppliers. All of the above is therefore protected by national and international legislation on intellectual and industrial property.

Any direct or indirect reproduction in whole or in part on any medium or format without the authorization of ATYCO is expressly prohibited. Any copying, reproduction, adaptation, modification, distribution, commercialization, public communication, making available or any other violation of current national and international regulations is also totally prohibited.

In order to preserve any intellectual or industrial property rights, in the event that any user or third party considers that there has been a violation of their legitimate rights due to the introduction of certain content on the website, they must notify ATYCO of this circumstance by email to the address showroom@atyco.es , indicating:

- Personal data of the interested party who is the owner of the rights that have allegedly been infringed. If the claim is submitted by a third party other than the interested party, they must provide proof of the representation with which they are involved.

The legitimacy of the intellectual or industrial property rights corresponding to the content provided by third parties is the exclusive responsibility of said third parties.

ATYCO does not assume any type of responsibility, even indirectly or subsidiarily, for the contents, information, communications, opinions or services linked from those websites not managed by ATYCO and that are accessible through the Web, nor does it guarantee the absence of viruses or other elements in them that may cause alterations in the computer system (hardware and software), in the documents or files of the user, excluding any responsibility for damages of any kind caused to the user for this reason.

6.- Non-compliance. Right of Exclusion:

Any breach of these terms of use will be subject to prosecution, as well as any improper use of the Website, and ATYCO may exercise any legal action that may be appropriate in defence of its legitimate interests. ATYCO reserves the right to deny or withdraw access to the Website, without prior notice, at its own request or that of a third party, to those users who breach these terms of use.

ATYCO may modify the terms set forth herein at any time, and such modifications shall be duly published as they appear here. The validity of the aforementioned terms of use shall depend on their presentation and shall remain in force until they are modified by other terms duly published.

8.- Privacy Policy:

8.1. Purpose of the data collected and consent to processing: The user is informed that, through the various registration forms on the Web, data is collected and stored in a file owned by ATYCO, duly registered with the Spanish Data Protection Agency, for the exclusive purpose of:

a) Maintain, where applicable, the business relationship consisting of the contracting of products and/or services offered through the Web, as well as the management, administration, information, provision and improvement of such services.

b) To send newsletters or newsletters , new entries ( posts ) from the ATYCO Blog, as well as commercial communications regarding promotions and/or advertising on the Web and in the architecture, interior design and furniture sectors.

All fields in said records marked with an asterisk are mandatory, and it is impossible to achieve the stated purpose if this data is not provided.

ATYCO undertakes to maintain the utmost confidentiality regarding the information provided to it and to use it only for the purposes indicated.

Only ATYCO and the data processors designated by it will have access to the user's data, and under no circumstances will this data be transferred, shared, or sold to any third party.

Acceptance of the privacy policy, by checking the acceptance box provided for this purpose, shall be understood for all purposes as the provision of express and unequivocal consent by the user to the processing of personal data in the terms set out in this document.

Compliance with applicable regulations: ATYCO complies with the guidelines of Organic Law 15/1999 of December 13 on the Protection of Personal Data (LOPD), Royal Decree 1720/2007 of December 21, which approves the Regulations for the development of said Organic Law (RLOPD) and other regulations in force and applicable at all times, ensuring the correct use and treatment of the user's personal data.

ATYCO also informs that it complies with Law 34/2002 of July 11, on Information Society Services and Electronic Commerce and that it will request the user's consent to the processing of their email for commercial purposes at all times.

8.3. Exercise of Rights of Access, Rectification, Cancellation and Opposition (ARCO rights): Any natural person who has provided their personal data to ATYCO (interested party or affected party) may exercise their ARCO rights free of charge, that is, the rights of access, rectification, cancellation and opposition with respect to the data incorporated in their files, which basically consist of the interested party being able to contact ATYCO at any time to find out what data of theirs is being processed, to correct errors or modify any inaccurate or incomplete data, to request its deletion if it is inadequate or excessive or to request that their data not be processed.

The interested party must remember that cancellation will not be appropriate when personal data must be kept for the periods provided for in the contractual relations between the interested party and the entity responsible for the processing.

Security Measures: ATYCO has implemented the necessary technical and organizational security measures to guarantee the security of the personal data collected and prevent its alteration, loss and unauthorized processing and/or access, taking into account the state of the technology, the nature of the data stored and the risks to which they are exposed, whether arising from human action or from the physical or natural environment.

8.5. Links: As a service to visitors to the Website, the Website may include hyperlinks to other sites that are not operated or controlled by ATYCO. Therefore, ATYCO does not guarantee, nor is it responsible for, the legality, reliability, usefulness, truthfulness and timeliness of the content of such websites or their privacy practices. Users are requested to take into account that their privacy practices may differ from those set forth in this document before providing personal information to these websites other than ATYCO.

8.6. Modification of the Privacy Policy: ATYCO reserves the right to modify its Privacy Policy, always in accordance with the applicable regulations or motivated by a legislative, jurisprudential or doctrinal change of the Spanish Data Protection Agency.
